Extension of residence permit in Ukraine under martial law
On 21 October 2022, the Cabinet of Ministers of Ukraine adopted Resolution No. 1202 “Certain Issues of Implementation of Legislative Acts in the Field of Migration under Martial Law” (hereinafter referred to as the “Resolution”). The Resolution allows foreign citizens and stateless persons, except for citizens of the russian federation, to enter and stay in Ukraine on the basis of a temporary or permanent residence permit, which has expired or is subject to exchange after 24 February 2022.
This regulation will be in force during martial law and for 30 days after its termination or cancellation.
Foreign citizens and stateless persons shall file documents for the exchange of temporary or permanent residence permits within 30 calendar days from the date of martial law expiration or cancellation.
Accordingly, if the validity of a residence permit expired after 24 February 2022, such a permit is deemed valid until the end of martial law, which in turn allows foreign citizens to enter and stay in Ukraine without hindrance.

In addition, the Resolution establishes that for the period of martial law, passports of citizens of Ukraine in the form of an ID card, the validity of which expired during the war, and passports of citizens of Ukraine of the 1994 design, which do not have a photo pasted in upon reaching the age of 25 or 45 (if the photo was to be pasted during the martial law), are considered valid identity documents and confirm the citizenship of Ukraine. Such documents are subject to exchange or pasting of new photos within 30 calendar days from the date of martial law termination or cancellation.
