DLF successfully defended the interests of Allianz Group in Ukraine

DLF attorneys-at-law have successfully represented the interests of Allianz Ukraine Superadded Liability Company, the leading Ukrainian insurance company, and the German international insurance company Allianz Global Corporate & Specialty SE in a complicated commercial dispute and achieved a favourable settlement.

Subject matter of the case

The DLF clients acted as insurers and reinsurers in the construction of renewable energy facilities in Ukraine.

In 2021, an industrial accident occurred during the construction of a wind farm involving the contractors engaged by the insured, resulting in damage to the insured’s high-value equipment.

DLF attorneys-at-law have worked intensively for over two years to establish the circumstances of the insured event and to determine the grounds for payment of the insurance indemnity.

Our clients have reaffirmed their reputation as reliable insurance partners by paying the insurance indemnity and, thus, acquired the right to claim compensation from persons who may have been involved in the insured event. As part of the right of recourse, our lawyers filed a subrogation action before a commercial court.

After a lengthy and complicated legal dispute and negotiations between the parties, a settlement was reached on the basis of which our clients received satisfactory compensation and were able to maintain good business relations with all parties to the dispute.

What made the case complicated?

The case was complicated primarily due to the unclear court practice in the application of subrogation in Ukraine, the statute of limitations in such cases and the assessment of the amount of damages.

DLF attorneys did a comprehensive job of building a sound position in the case, gathering evidence and developing an effective litigation strategy that was approved and supported by our clients.

The need to maintain a balance between the protection of property interests and the future development of business relations between all parties to the proceedings led to the conclusion of a settlement agreement that satisfied our clients’ interests.
