Obtaining the Force Majeure Certificate in Ukraine
On 23 March 2020, taking into account the situation, in which many companies found themselves in Ukraine, and the quarantine, introduced by the Cabinet of Ministers of Ukraine, the Chamber of Commerce and Industry of Ukraine has simplified the procedure for filing the applications and documents for obtaining the force majeure certificate.
Now, you will need the following documents to obtain the force majeure certificate:
- a statement signed by the Head and affixed thereon with the company seal (if any);
- a copy of a contract / agreement;
- a copy of the order / directive in connection with the necessity to cease activities on the basis of the relevant laws and regulations;
- a communication / notice to be served to the other party.
The documents should be sent electronically to: ucci@ucci.org.ua, or in paper form to the central office in Kyiv and 24 (twenty four) regional offices.
The documents should be considered within seven business days, and in the case of an individual’s application, within twenty-one business days.
Also, it should be noted that the company is entitled to apply to the Chamber of Commerce for the force majeure certificate and obtaining such a certificate in case of already missed deadlines for complying with its obligations and liabilities due to the quarantine.
